Description: Spouse and unmarried children under 21 of permanent residents (Family 2A category only), who have been waiting for permanent residence for three or more years from the time the INS received a second preference petition filed on his or her behalf.

Limitation: Family 2A category only. The INS must have received the applicant’s second preference petition on or before December 21, 2000.

Special: Periods in the United States in unauthorized status will not prevent someone from obtaining a V visa. Individuals already in the United States are also allowed to “adjust status” to this V category.

Application: V visa applicants outside of the United States apply at a U.S. Consulate abroad and must use the new form DS-3052 in supplement to the standard OF-156 Non-immigrant visa application form.
